Mother claims West Houston Medical Center failed to protect daughter

HOUSTON — A mother is suing a health care provider, citing alleged insufficient measures were taken to prevent her daughter's injuries and death.

Helen Ware, individually and as personal representative of the estate of Nishena Ware filed a complaint June 12 in the Harris County District Court against SHCA West Houston LP, doing business as West Houston Medical Center, alleging that the health care provider breached its duty to implement security measures to protect plaintiff's decedent from harm.

According to the complaint, the plaintiff alleges that on July 17, 2015, Nishena Ware was a patient at defendant's facility when her boyfriend, Robin Clay, allegedly held a pillow on top of her head to kill her. Clay had badly beaten the patient, leaving extensive facial swelling, lacerations and broken teeth to her face, the complaint states. She died as a result of her injuries July 25, 2015, according to the complaint. The plaintiff suffered loss of love, comfort and society of her daughter. The plaintiff holds the defendant responsible because its employees allegedly failed to provide a minimum standard of care to prevent the plaintiff's decedent from being beaten.

The plaintiff requests a trial by jury and seeks actual, general and special damages, pre- and post-judgment interest, costs incurred for this law suit and such other just and proper relief. She is represented by Kristina Frankel of Brown & Brothers in Houston.
