Construction worker alleges employer failed to pay overtime

SHERMAN — A Harris County construction worker has filed a class action lawsuit against a construction business, alleging violation of workers compensation acts in failing to pay overtime.

Victor Garcia Sanchez, individually and on behalf of all others similarly situated, filed a complaint June 29 in the Sherman Division of the Eastern District of Texas against R&R Multi-Trade Construction Services LLC, alleging violation of the Fair Labor Standards Act.

According to the complaint, Sanchez regularly work more than 40 hours a week between February-June 2017 on the Westin Hotel in Las Vegas without receiving overtime compensation for all hours worked of more than 40 per workweek. The plaintiff alleges the defendant paid him a flat day rate regardless of the number of hours he worked per week.

Sanchez seeks trial by jury, unpaid overtime premiums, plus liquidated damages, attorney fees, court costs and expenses and all other relief. He is represented by attorney Beatriz Sosa-Morris of Sosa-Morris Neuman Attorneys at Law at Law in Houston.
