Michelin North America Inc., others named in suit after tire allegedly caused collision

HOUSTON – A Hallettsville couple seeks more than $1 million in damages after an allegedly defective tire caused an accident that claimed the life of a minor child.

Rosa Irma Molina and Hector Ochoa filed a complaint on July 11, in the Harris County District Court against Michelin North America Inc., Macias Tire Services and Boedeker AG Supply LLC alleging strict liability, negligence and other counts.

According to the complaint, the plaintiffs allege that on June 8, 2017, plaintiff Molina and her minor child were severely injured when the driver-side rear tire of the vehicle they were riding failed, causing the plaintiff to lose control of the vehicle and be struck by an 18-wheeler being driven by defendant Boedeker's employee. The suit states Hector Ochoa acquired the tire in question at Macias Tire Services two weeks before the accident, and the child was later pronounced dead.

The plaintiffs holds Michelin North America Inc., Macias Tire Services and Boedeker AG Supply LLC responsible because defendants Michelin and Macias failed to provide warning of the dangerous propensity of the tire's tread to unexpected separate and/or fail, and defendant Boedeker negligently entrusted the vehicle to its employee.

The plaintiffs request a trial by jury and seek damages of more than $1 million, plus interest, costs of court and all other relief to which they may be entitled. They are represented by Anthony G. Buzbee and Ryan S. Pigg of The Buzbee Law Firm in Houston.
