HOUSTON – A Spring couple has filed a suit against a Spring establishment after the husband was hit by an allegedly drunk driver.

Cornelius Scaife and Brandy Scaife filed a complaint on July 19 in the Harris County District Court against Mak's Place LLC and Taylor Tobias alleging that they violated the Texas Dram Shop Act and the Texas Alcoholic Beverage Code.

According to the complaint, on Aug. 29, 2015, Cornelius Scaife was critically injured when defendant Tobias ran him down at a high rate of speed in his car while intoxicated. He alleges he suffered severe injuries resulting in pain and suffering, medical expenses disfigurement and loss earning. Plaintiff Brandy Scaife claims she suffered a loss of consortium and society of her husband. 

The plaintiffs holds Mak's Place LLC and Taylor Tobias responsible because defendant Mak's allegedly over-served alcoholic beverages to defendant Tobias and allowed him to leave the premises after being obviously intoxicated and defendant Tobias failed to safely operate his vehicle.

The plaintiffs seek monetary relief of more than $1 million and all other damages to which they may be entitled. They are represented by Anthony Malley III of Malley Law Firm PLLC in Beaumont.
