Former Mosquito Joe employee alleges he is owed unpaid overtime wages

HOUSTON – A pest control sprayer alleges he was paid the same rate regardless of how many hours he worked.

Mario Fobbs filed a complaint on July 19 in the Houston Division of the Southern District of Texas against Buzzzz Be Gone LLC, doing business as Mosquito Joe, and Brooke Thompson alleging that they violated the Fair Labor Standards Act.

According to the complaint, the plaintiff was employed by the defendants as an hourly pest control sprayer from June 2015 to Aug. 1, 2016. He alleges that he worked an average of 60 hours per week without receiving overtime premiums for all hours worked in excess of 40 per workweek. 

The plaintiff requests a trial by jury and seeks unpaid overtime wages, liquidated damages, attorney’s fees and costs and all other remedies as the court deems just and appropriate. He is represented by James M. Loren and Rachael Rustmann of Goldberg & Loren PA in Dallas.
