Consumer alleges she was damaged by actions of Edward D. Jones employee regarding annuity

HOUSTON – A Katy consumer alleges she has been damaged by the negligent misrepresentation of a financial adviser and insurance company.

Nancy Grace Smith filed a complaint on July 21 in the Harris County District Court against Edward D. Jones & Co. LP and Massachusetts Mutual Life Insurance Co. alleging that they violated the Texas Deceptive Trade Practices Act and the Texas Insurance Code.

According to the complaint, the plaintiff alleges that she was forced by an Edward Jones' employee to purchase a Mass Mutual RetireErase Choice Annuity. She alleges the employee was acting on an effort to obtain commission from the sale of the annuity.

The plaintiff holds Edward D. Jones & Co. LP and Massachusetts Mutual Life Insurance Co. responsible because defendant Edward Jones allegedly aggressively coerced her to purchase the annuity and failed and refused to refund her money used in purchasing the annuity.

The plaintiff seeks actual, exemplary and treble damages, plus interest, costs of court and all further relief to which she may be entitled. She is represented by Lisa S. Liles of Lisa Liles & Associates in Houston.
