HOUSTON – A Baytown physician is seeking judgment regarding another doctor's contract claims.

Edward W. Leahey MD and Edward W. Leahey MD PA filed a complaint on July 24, in the Harris County District Court against Shehzad Sami MD seeking declaratory judgment.

According to the complaint, the defendant was employed by the plaintiffs as an associate doctor for nearly three years before he was terminated for unacceptable conduct. The suit states initially the plaintiffs were hoping to form a partnership with the defendant but the parties could not agree to partnership and buy-out terms.

The plaintiffs holds Sami responsible because the defendant allegedly asserted that he is entitled for payments that were never agreed and threatened to sue plaintiffs for claims arising from an unsigned employment contract.

The plaintiffs seek an order declaring that the parties' agreement does not entitle defendant to partnership rights, attorney's fees, costs and such other additional relief to which they are entitled. They are represented by Rachel Powitzky Steely and Jake Hicks of Gardere Wynne Sewell LLP in Houston.
