HOUSTON – A Harris County company is accused of terminating an employee after she requested medical leave for her pregnancy.
Carmen Cortes filed a complaint on July 27 in the Houston Division of the Southern District of Texas against Westlex Corp., doing business as Northside Lexus, alleging that the former employer violated the Family Medical Leave Act.
According to the complaint, the plaintiff was employed by the defendant as a data entry clerk at its Houston office beginning in 2015. She alleges she requested time off for a medical leave for her pregnancy in early September 2016 and was terminated on Sept. 29, 2016.
The plaintiff holds Westlex Corp. responsible because the defendant allegedly retaliated against her and terminated her employment because of her request for medical leave.
The plaintiff requests a trial by jury and seeks actual and liquidated damages, pre- and post-judgment interest, attorney’s fees, costs and all other relief to which she is justly entitled. She is represented by Shane A. McClelland of Herbert & McClelland LLP in Houston.
