Former employee alleges S4 Communications retaliated against her for asserting FMLA rights

HOUSTON – A Harris County woman alleges that her former Houston employer interfered with her right to take a medical leave.

Kimberly Lavine filed a complaint on July 27 in the Houston Division of the Southern District of Texas against S4 Communications LLC alleging violation of the Family Medical Leave Act.

According to the complaint, the plaintiff was employed by the defendant as a sales manager and on Sept. 15, 2016, she was diagnosed with malignant hypertensive heart disease that rendered her incapable of performing the essential functions of her job. The suit states that on Oct. 18, 2016, she was terminated from her employment. 

The plaintiff holds S4 Communications LLC responsible because the defendant allegedly ignored her doctor’s submitted FMLA form, required her to return to work and retaliated against her by terminating her for asserting her FMLA-protected rights.

The plaintiff requests a trial by jury and seeks actual and liquidated damages, plus interest, attorney’s fees, costs and all other relief to which she is justly entitled. She is represented by Shane A. McClelland of Herbert & McClelland LLP in Houston.
