Finishes Etc. LLC employee alleges injuries after scaffolding collapsed

GALVESTON – A Victoria County resident alleges he was injured during the scope of his employment when the scaffolding he was using collapsed.

Luis Jaime Salazar filed a complaint on July 31 in the Galveston County District Court against David K. Peavy and Finishes Etc. LLC alleging negligence.

According to the complaint, the plaintiff alleges that on Nov. 4, 2015, he was working for defendants' construction project at the Comfort Inn & Suites in Galveston when the scaffold collapsed, causing him to fall to the ground. He alleges he sustained severe and permanent injuries and suffered physical pain, mental anguish, disfigurement, loss income and medical expenses. 

The plaintiff holds Peavy and Finishes Etc. LLC responsible because the defendant allegedly failed to provide proper equipment and tools to enable their employees to perform their duties safely.

The plaintiff requests a trial by jury and seeks monetary relief of more than $200,000 but not more than $1 million and such other and further relief. He is represented by Andrew E. Toscano of Gene Toscano Inc. in San Antonio.
