Landlord claims 8433 Gulf Freeway Inc., Jack's Carpet Inc. owes unpaid rent

HOUSTON – A Houston landlord alleges he is owed more than $50,000 for rent on a Katy property.

Charles Schwarz Jr. filed a complaint on July 31 in the Harris County District Court against 8433 Gulf Freeway Inc. and Jack's Carpet Inc. alleging breach of contract.

According to the complaint, the plaintiff and Jack's Carpet entered into a lease agreement for a Katy property in 2010, which was later assigned to Gulf Freeway in 2013. The suit states Gulf Freeway failed to make timely rent payments in 2016. The plaintiff alleges he terminated the defendants' lease in January and demanded payment in full of all monies owed.

The plaintiff seeks actual damages in the amount of $56,091.28, attorney's fees, costs of court, pre- and post-judgment interest and all other lawful and equitable relief. He is represented by Cynthia R. Levin Moulton and Carey T. Wallick of Moulton, Wilson & Arney LLP in Houston.
