Individual claims cooling system failure at CubeSmart facility damaged property

HOUSTON – A Montgomery County consumer alleges items she had a in a climate-controlled storage facility were damaged.

Sarah Paul filed a complaint on Aug. 3 in the Harris County District Court against Cube HHF Limited Partnership, doing business as CubeSmart, alleging violation of the Texas Deceptive Trade Practices Act and other counts.

According to the complaint, the plaintiff rented climate-controlled storage space from a facility operated by the defendant and stored high-end furniture and art for nearly 10 years.

The suit states that the defendant discovered that the cooling system had failed on the facility and that this failure caused her property to be covered in mold. She alleges it is a total loss.

The plaintiff seeks judgment against defendant for damages sustained by plaintiff and all other equitable relief to which she may be entitled. She is represented by Kevin A. Forsberg of The Fosberg Law Firm PC in Montgomery.
