HOUSTON – A man alleges he was not paid overtime by his former employer for his work as an installer.
Darwin Padilla filed a complaint on Aug. 4 in the Houston Division of the Southern District of Texas against Division 9 Inc. and Jorge Salazer alleging that they failed to comply with the overtime provisions of the Fair Labor Standards Act.
According to the complaint, the plaintiff worked for the defendants as an installer from June 2013 to June 2017. The plaintiff holds Division 9 Inc. and Salazar responsible because the defendants allegedly failed to pay the required overtime premium for all hours the plaintiff worked in excess of 40 hours per week.
The plaintiff requests a trial by jury and seeks to recover unpaid overtime compensation, liquidated damages, attorney’s fees and such other just and equitable relief. He is represented by Josef F. Buenker and Vijay Pattisapu of The Buenker Law Firm in Houston.
