HOUSTON – A cattle owner alleges that he is currently not able to retrieve his cattle after a breach of a sublease.
William Barnett filed a complaint on Aug. 8 in the Harris County District Court against Ronnie Whitehead and Weiss Land and Development LLC alleging breach of sublease.
According to the complaint, in 2013, Whitehead approached the plaintiff about the lease of pasture and offered a sublease to the plaintiff. The plaintiff alleges the sublease was for a term of 10 years, and that the plaintiff has paid at least $10,000 on constructing a fence for his cattle on the land.
The suit states in October 2016, the defendant told the plaintiff to remove his cattle from the pasture. In December of the year, the plaintiff alleges he received a letter from the defendant stating that if the defendant did not remove his cattle, the defendant would. The plaintiff alleges he has not been allowed on the property to retrieve his cattle.
The plaintiff seeks actual, special and consequential damages, costs of suit and any further relief to which he is justly entitled. He is represented by Sidney Levine of Sidney Levine Attorney at Law in Sealy.
