GALVESTON – The beneficiaries of a life insurance policy allege that the insurance company misrepresented the policy's status.
Deborah Aduddell, David Ferguson and Eric Ferguson filed a complaint on Aug. 10 in the Galveston County District Court against Farmers New World Life Insurance Co. and Farm Bureau Life Insurance Co. alleging breach of contract and other counts.
According to the complaint, the plaintiffs are the named beneficiaries of a life insurance policy of Darrell Ferguson. The suit states that the policy lapsed and attempts were made to pay the outstanding balance before Ferguson's death, but Darrell Ferguson's wife was allegedly told by a Farmers New World representative that the policy was still in force.
The plaintiffs holds Farmers New World Life Insurance, Co. and Farm Bureau Life Insurance Co. responsible because the defendants allegedly failed to inform the decedent's wife that if Darrell Ferguson died before she made the payment, the policy would permanently lapse.
The plaintiffs request a trial by jury and seek monetary relief of $150,000 in damages, $450,000 in statutory and/or punitive damages, court costs, expenses, attorney's fees, pre- and post-judgment interest and such other additional relief.
