GALVESTON – Subcontractors allege that they were not compensated for work on construction projects.
Modesto Mendez, Yoandry Rodriguez, Hector Gavilan, Rolando Herrera, Lazaro Campos, Alberto Gonzalez and Manuel Fond filed a complaint on Aug. 18 in the Galveston County District Court against Kenny V. Wagner, Shawn Wagner and MZKV Coastal Realty LLC alleging breach of contract and other counts.
According to the complaint, the plaintiffs allege that they provided valuable goods or services to defendants' various construction projects.
The plaintiff holds Kenny V. Wagner, Shawn Wagner and MZKV Coastal Realty LLC responsible because the defendants allegedly failed to pay labor, materials and/or equipment provided by plaintiffs to defendants' projects.
The plaintiff requests a trial by jury and seeks actual damages, foreclosure of plaintiffs' mechanic’s liens against the project, plus interest, attorneys’ fees, costs and such other and further relief.
