Former Wells Fargo Insurance Services USA employee seeks declaration regarding agreement

HOUSTON – A Harris County man and his current employer are seeking declaration regarding an employment agreement from the man's former employer.

William "Billy" Bray and Alliant Insurance Services Inc. filed a complaint on Aug. 23 in the Galveston County District Court against Wells Fargo Insurance Services USA Inc. seeking declaratory judgment.

According to the complaint, Bray was a former at-will employee of the defendant and resigned on Aug. 23. The suit states Bray now works for Alliant Insurance Services Inc.

Bray alleges that while an employee of the defendant, he signed an employment agreement that contained a nonsolicitation provision, but that this agreement does not restrict him from providing products or services to the defendant's customers or clients.

The plaintiffs seek declaratory judgment that Bray is "not restrained from accepting business from and performing services for defendant's clients," according to the suit.

The plaintiffs seek declaration that the employment agreement does not restrain plaintiff Bay from accepting business from and servicing defendant's clients, costs of suit and attorneys' fees. They are represented by Rachel Powitzky Steely and Michael Rahmn of Gardee Wynne Sewell LLP in Houston.
