HOUSTON – A life insurance beneficiary is accusing an insurance company of false, misleading and deceptive acts in relation to an insurance policy.
Beverly Jenkins filed a complaint on Aug. 28 in the Harris County District Court against Globe Life and Accident Insurance Co. alleging violation of the Texas Insurance Code.
According to the complaint, the plaintiff alleges that she is the named beneficiary of a life insurance policy issued by the defendant to Alfonzie Jenkins. She alleges the defendant has refused to pay the face amount of the policy because it claims Alfonzie Jenkins misrepresented her date of birth on the enrollment forms.
The plaintiff alleges that the date of birth is clearly stated on the application and that the defendant did not attempt in good faith to effect a prompt and equitable settlement of the claim.
The plaintiff seeks monetary relief of more than $100,000 and such other relief to which she is entitled. She is represented by Jason L. Harvey of Duggins Wren Mann & Romero LLP in Austin.
