Woman files suit against Capital One Asset Management over handling of trust

HOUSTON – A Sugar Land woman alleges a bank has failed to make disbursements from a trust.

Pamela J. Curtis filed a complaint on Sept. 4 in the Harris County District Court against Capital One Asset Management LLC, individually and as trustee of the Pamela J. Curtis Reversionary Trust alleging breach of fiduciary duty and seeking declaratory judgment.

According to the complaint, the plaintiff's trust was created in 2004 as part of a settlement agreement with the U.S. Department of Health and Human services after she was injured by a vaccine. The suit states the original trustee of the trust was Hibernia National Bank, which was acquired by the defendant.

The plaintiff holds Capital One Asset Management LLC, individually and as trustee of the Pamela J. Curtis Reversionary Trust responsible because the defendant allegedly failed to make timely payments on necessary accounts and basic necessities and declined her request for disbursements.

The plaintiff requests a trial by jury and seeks damages within the jurisdictional limits of the court, attorney's fees and expenses and such other lawful and equitable relief. She is represented by David S. Cook and Zachary A. Clark of Cook Law PLLC in Houston.
