HOUSTON – An employee at a Houston warehouse is seeking $1 million in damages after an accident at the facility.

Marivel Rubio filed a complaint on Sept. 7 in the Harris County District Court against SJR Foods LTD, doing business as El Venado Foods, alleging negligence.

According to the complaint, the plaintiff alleges that on July 1, 2017, she was working at defendant's facility when a co-worker activated the machine she was cleaning. As a result, the suit states she is missing half of her right hand and is permanently disfigured. She alleges she has suffered pain and suffering, mental anguish, loss of earnings and medical expenses.

The plaintiff holds SJR Foods LTD, doing business as El Venado Foods, responsible because the defendant allegedly failed to have and enforce a log-out, tag-out program on the machine she was cleaning and failed to provide necessary training, safety guidelines and protection to prevent accidents.

The plaintiff requests a trial by jury and seeks monetary relief of more than $1 million and such other lawful and equitable relief. She is represented by Justin Carlisle of Law Offices of Domingo Garcia LLP in Houston.
