Port Arthur alleges city-owned credit cards were fraudulently used to purchase fuel

BEAUMONT – The city of Port Arthur alleges two employees dishonestly used city property for their personal use and benefit.

The city of Port Arthur, by and through Texas Municipal League Intergovernmental Risk Pool, as subrogee, filed a complaint on Aug. 29 in the Jefferson County District Court against Rabindra Nauth; Steven Robert Guidry Jr.; Randle Davis Jr.; David  Fitzgerald Frank, individually and doing business as Frank's Trucking; et al. alleging conversion, fraud and other counts.

According to the complaint, Guidry and Davis, who were Port Arthur, street department supervisors, were entrusted with city-owned Fuelman credit cards to purchase diesel fuel for street department equipment. The plaintiffs allege Nauth and Frank obtained the cards from Guidry and Davis and used them to purchase diesel fuel for Frank's Trucking. Guidry and Davis were allegedly paid by Nauth and Frank for the use of the cards.

The suit states that the Port Arthur city manager filed a report with the police department in 2015, and that criminal charges against the defendants are pending.

The plaintiff requests a trial by jury and seeks damages in the amount of $279,921.20, with interest, costs of court, attorney's fees and such other relief to which it may show itself justly entitled. It is represented by Charles "Bo" Joseph, Jennifer O'Sullivan and Brittani S. Miller of Texas Municipal League Intergovernmental Risk Pool in Austin.
