Man alleges he suffered punctured lung when trying to remove vehicle from hole in Humble parking lot

HOUSTON – A Harris County man alleges he sustained severe injuries because of a hole in a gravel parking lot in Humble.

Fernando Ayala filed a complaint on Sept. 19 in the Harris County District Court against Magen IV Inc., doing business as Atascocita Market Square Inc., and Atascocita Partners LTD alleging premises liability.

According to the complaint, the plaintiff alleges that on June 22, 2016, he sustained severe injuries when his vehicle's suspension fell into one of the deep holes in the gravel parking lot on the boundary line of defendants' properties. He alleges he suffered a punctured lung and a broken collarbone while trying to remove the vehicle and it collapsed.

The plaintiff holds Magen IV Inc. and Atascocita Partners LTD responsible because the defendants allegedly failed to use ordinary care in maintaining the parking lot.

The plaintiff requests a trial by jury and seeks monetary relief of more than $100,000 but not more than $1 million and all other relief to which he is entitled. He is represented by Jose R. Lopez II and Frank Sedita of Law Offices of Jose R. Lopez II PC in Houston.
