HOUSTON – A Texas man alleges he was almost killed while working at a Louisiana plant because the defendants failed to ensure the area was properly maintained.
Stephen Thompson filed a complaint on Sept. 19 in the Harris County District Court against Total Petrochemicals and Refining USA Inc., Turner Industries Group LLC, et al. alleging negligence, intentional tort assault and battery and other counts.
According to the complaint, the plaintiff was employed as a contractor for Turner at the Carville, Louisiana plant owned and/or operated by Turner and defendant Cos-Mar Co. He alleges he was nearly killed in May when he was buried alive by a ton of hazardous catalyst. He alleges he sustained severe physical injuries and was nearly killed.
The plaintiff holds Total Petrochemicals and Refining USA Inc., Turner Industries Group LLC, et al. responsible because the defendants allegedly failed to maintain a safe work area, failed to provide adequate training, hold sufficient supervision and pre-job safety meetings and failed to warn invitees of dangerous conditions and/or equipment.
The plaintiff requests a trial by jury and seeks actual, compensatory and consequential damages, costs of court and all other relief that are just and proper. He is represented by Nicholas A. Morrow, John D. Sheppard and Daniel E. Sheppard of Morrow & Sheppard LLP in Houston.
