HOUSTON – Several Harris County residents are seeking more than $1 million in damages over allegations that an oil and gas exploration company failed to properly secure its crude oil storage tanks.
Luis and Gertrude Stuart, et al. filed a complaint on Sept. 21 in the Harris County District Court against D-Mil Production Inc. alleging negligence.
According to the complaint, the plaintiffs live in the Mossy Oaks subdivision. The suit states in May 2016, Spring Creek flooded, knocking over defendant's storage tanks and "contaminating plaintiffs' property and dwellings with many barrels of crude oil permanently impacting their property and spoliation of the area where they live."
The plaintiffs hold D-Mil Productions Inc. responsible because the defendant allegedly failed to tie down their crude oil storage tanks, failed to elevate the same and failed to pump water into the storage tanks to keep them from turning over.
The plaintiffs request a trial by jury and seek monetary relief of more than $1 million and such other general and special relief. They are represented by Michael A. Moriarty and Michael D. West of Moriarty Law Firm in Houston.
