Construction firm demands payment from City of Bellaire for services performed at park

HOUSTON – A construction firm claims the City of Bellaire owes it back payments for work done on a park, recent Harris County District Court records show.

The Linbeck Group, LLC sued Bellaire on Sept. 21 in the Harris County 152nd District Court, alleging a breach of contract in connection with improvements it performed at Evelyn’s Park.

Court documents explain that Linbeck adhered to its contractual obligations, as well as timely notified the city of weather-related delays and submitted corresponding proposed changes with documentation.

The respondent, however, has refused to adjust the contract time and guaranteed maximum price, the original petition says.

Linbeck further accuses the city of withholding the balance of the contract sum from the final payment.

The suit does not specify on the exact monetary figure the plaintiff seeks, but says the company demands at least $200,000 in damages.
