Automobile dealer alleges individual unlawfully purchased two vehicles through NextGear floor plan

HOUSTON – A Harris County man alleges that two vehicles were purchased without his knowledge through his floor plan.

Alireza Delavari Maryan filed a complaint on Sept. 26 in the Harris County District Court against NextGear Capital Inc., US Financial Auto Credit LLC, Melissa Webb Bryant and Saeid Hashemnezad alleging conspiracy, fraud by nondisclosure and other counts.

According to the complaint, the plaintiff operates a car dealership through his Texastar Financial Group and obtains financing for his transactions through lines of credit known as floor plans. The suit states that on June 24, 2016, he entered into a demand loan agreement with NextGear for up to $150,000 in exchange for a comparable collateral. 

The suit states the plaintiff later discovered that Hashemnezad had purchased two vehicles in plaintiff's name using the NextGear plan, and that Bryant authorized the financing. The plaintiff alleges this purchase was made without his consent or knowledge.

The plaintiff holds NextGear Capital Inc., US Financial Auto Credit LLC, Bryant and Hashemnezad responsible because the NextGear allegedly failed to confirm the identities of parties to loan transactions and failed to implement adequate security systems.

The plaintiff requests a trial by jury and seeks monetary relief of more than $200,000 but not more than $1 million and such other legal and equitable relief. He is represented by Matthew M. Zarghouni of Zar Law Firm in Houston.
