Trinity Valley Pools & Spas Inc., TVP Authority LLC alleged to have failed to pay overtime

TYLER – A Whitehouse man alleges his joint employers failed to pay him overtime during his employment.

Brandon Parnell filed a complaint on Sept. 27 in the Tyler Division of the Eastern District of Texas against Trinity Valley Pools & Spas Inc. and TVP Authority LLC alleging that they violated the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that during his employment with defendants between Oct. 24, 2016, and Aug. 14, 2017, he was not paid overtime wages at a rate of one-and-one-half times his regular rate for all hours worked in excess of 40 hours per week. 

The plaintiff holds Trinity Valley Pools & Spas Inc. and TVP Authority LLC responsible because the defendants allegedly paid him a fixed salary each week without any overtime compensation as required by law.

The plaintiff seeks unpaid overtime, liquidated damages, attorney fees, litigation expenses and all available equitable relief. He is represented by William S. Hommel Jr. of Hommel Law Firm in Tyler.
