CEMEX Construction Materials Houston claims it is owed more than $37,000 for goods

GALVESTON – A building materials company alleges it was not paid for materials it supplied for a project in League City.

CEMEX Construction Materials Houston LLC filed a complaint on Sept. 28 in the Galveston County District Court against Montgomery County Concrete LLC, Jason Warren, Bradley Warren and AR Partners LLC alleging breach of contract.

According to the complaint, the plaintiff alleges that it furnished ready-mix concrete, aggregate and related supplies and labor to defendant's project on credit from March to July. After allowing all offsets and credits for payments, the amount of $37,003.12 allegedly remains unpaid. 

The plaintiff holds Montgomery County Concrete LLC, Jason Warren, Bradley Warren and AR Partners LLC responsible because the defendants allegedly failed and refused and continues to fail and refuse to pay the full amount due and owing.

The plaintiff seeks monetary relief of $100,000 or less and such other and further relief to which it may show itself justly entitled. It is represented by Sean M. Rooney and Jacob D. Herberger of JD Herberger & Associates PC in Houston.
