HOUSTON — A tenant is suing Marquee Uptown, McCue Road Properties LLC and Jeffrey Levine, the apartment building owner and manager, alleging that insufficient measures were taken to prevent injuries.
Roxane E. Martinez filed a complaint on Sept. 29 in the Harris County District Court against the defendants, alleging that they failed to maintain their apartment complex in a reasonably safe condition.
According to the complaint, the plaintiff alleges that on Sept. 30, 2015, she was seriously injured when she slipped and fell on water that leaked from a commercial air conditioning unit on the second floor of the defendants' building and pooled in her first-floor apartment. She has suffered pain and suffering, mental anguish, loss earnings and medical expenses, the complaint said. The plaintiff holds Marquee Uptown, McCue Road Properties LLC and Levine responsible because the defendants failed to permanently remedy the dangerous condition despite being given notice of the water leaks prior to the incident.
The plaintiff requests a trial by jury and seeks monetary relief of more than $200,000 but not more than $1 million, as well as other equitable relief. She is representing herself.
