MARSHALL — A truck driver has filed a lawsuit against Carvana LLC and a company employee, Donzell El Toro Sledge, alleging that their negligence led to a collision and subsequent injuries.
Charles James Richter filed a complaint on Oct. 3 in the Marshall Circuit Court against the defendants, alleging that defendant Carvana negligently entrusted a motor vehicle to defendant Sledge.
According to the complaint, the plaintiff alleges that on June 28, 2017, he sustained personal injuries when the truck tractor he was driving was struck by a commercial motor vehicle being operated by defendant Sledge and owned by defendant Carvana. He has suffered pain, mental anguish, disfigurement, lost wages and medical expenses, the complaint says. The plaintiff holds Carvana LLC and Sledge responsible because defendant Sledge allegedly failed to exercise ordinary care and prudence in operating the tractor trailer by failing to maintain a safe distance and by failing to timely and properly apply brakes to avoid the collision.
The plaintiff requests a trial by jury and seeks actual, punitive and exemplary damages, pre- and post-judgment interest and such other relief to which he is justly entitled. He is represented by Joe M. Worthington of Negem & Worthington in Tyler.
