Mechanical engineer accuses Union Pacific of discrimination

HOUSTON — A mechanical engineer is suing Union Pacific Corp., citing alleged disability discrimination and wrongful termination.

Olatunbosun Afolabi of Washington, D.C., filed a complaint on Oct. 3 in the Houston Division of the Southern District of Texas against the railroad operator, alleging that Union Pacific willfully violated the Texas Commission on Human Rights Act.

According to the complaint, the plaintiff alleges that as a result of the defendant’s unlawful conduct, he has suffered lost wages and fringe benefits, emotional pain and suffering, inconvenience, mental anguish and injury to his professional standing, character and reputation. The plaintiff holds Union Pacific Corp. responsible because the defendant allegedly subjected him to an illegal medical examination without reasonable cause and discharged him as a direct result of his disability.

The plaintiff requests a trial by jury and seeks all damages, reinstatement or front pay, pre- and post-judgment interest, attorneys’ fees and costs and any other proper and lawful relief. He is represented by Kell A. Simon of the Law Offices of Kell A. Simon in Austin.
