Houston resident accuses debt collector of unfair practices

HOUSTON — A consumer is suing Tolteca Enterprises Inc., which does business as Phoenix Recovery Group, alleging deceptive and unfair debt-collection practices.

Morgan Johnson filed a complaint on Oct. 5 in the Houston Division of the Southern District of Texas against Tolteca Enterprises, claiming that the debt collector violated the Fair Debt Collections Practices Act.

According to the complaint, the plaintiff alleges that on Oct. 12, 2016, she received a collection letter from the defendant advising her that a $12 processing fee for each credit card transaction would be added to the payment amount when it is processed. As a result, she has claimed financial harm. The plaintiff holds Tolteca Enterprises responsible because the defendant allegedly attempted to collect an amount that she does not owe.

The plaintiff requests a trial by jury and seeks actual and statutory damages, attorney fees and costs, and other just and proper relief. She is represented by Michael Jay Ringelheim of RC Law Group PLLC in Hackensack, N.J.
