Pharmacy tech alleges Medical Park Pharmacy terminated her because of age, disability

MARSHALL – A Gregg County woman formerly employed as a pharmacy tech alleges she lost her job because of her age and disability.

Kristen L. Patterson filed a complaint on Oct. 10 in the Marshall Division of the Eastern District of Texas against KCN Novak LLC, doing business as Medical Park Pharmacy, and Pharmacy of Longview LLC citing the Americans with Disabilities Act and Title VII of the Civil Rights Act of 1964.

According to the complaint, the plaintiff alleges that in July 2016, she was diagnosed with multiple sclerosis and disclosed it to the defendants. She alleges on Sept. 2, 2016, she was laid off. The suit states that her replacement was in her 30s and the plaintiff alleges she was terminated because she is older than 40 and because of her diagnosis.

The plaintiff holds KCN Novak LLC and Pharmacy of Longview LLC responsible because the defendants allegedly failed to provide reasonable accommodation and directly discriminated against her on the basis of her actual or perceived disability and terminated her and replaced her with a younger employee.

The plaintiff requests a trial by jury and seeks back pay, compensatory damages, liquidated damages, attorney fees, costs and expenses and such other and further relief. She is represented by William S. Hommel Jr. of Hommel Law Firm in Tyler.
