Former Troy Construction employee alleges he, class members owed unpaid overtime

GALVESTON – A Houston County man alleges his former pipeline and facility construction and maintenance company employer misclassified him as exempt from receiving overtime pay.

Roger Hensley, individually and on behalf of all others similarly situated, filed a complaint on Oct. 12 in the Galveston Division of the Southern District of Texas against Troy Construction LLC alleging violation of the Fair Labor Standards Act.

According to the complaint, the plaintiff was employed by the defendant as a QC inspector from January 2016 to March 2017. He alleges that he regularly worked for more than 40 hours in a workweek without receiving overtime compensation for all hours worked in excess of 40 in a workweek at one-and-one-half times his regular rate of pay. 

The plaintiff holds Troy Construction LLC responsible because the defendant allegedly misclassified him and other similarly situated workers as exempt from the overtime provision of the FLSA.

The plaintiff requests a trial by jury and seeks an order designating this class as a collective action, awarding him and the class members all their unpaid overtime compensation and liquidated damages, attorneys’ fees and costs and such other and further relief.
