Young County Home Health Care Inc. nurse alleges that she was not paid overtime pay

SHERMAN – A licensed vocational nurse claims that her home health care employer has failed to pay her the correct rate for overtime work.

Vicky Cochran filed a complaint on Oct. 16 in the Sherman District of the Eastern District of Texas against Young County Home Health Care Inc., Mickie Dicken and Ronald Dicken alleging violation of the Fair Labor Standards Act.

According to the complaint, the plaintiff began her employment with the defendants in 2002 as a licensed vocational nurse. She alleges she consistently worked for more than 40 hours a week without receiving overtime compensation. 

The plaintiff holds Young County Home Health Care Inc., Mickie Dicken and Ronald Dicken, responsible because the defendants allegedly failed to pay employees for overtime hours worked in excess of 40 hours per week at a rate of no less than one-and-one-half times their regular rate of pay.

The plaintiff seeks to recover overtime compensation, liquidated damages, attorney’s fees, litigation costs, pre- and post-judgment interest and such other and further relief that are lawful and equitable. She is represented by Douglas B. Welmaker of Dunham & Jones PC in Austin.
