BEAUMONT – Chevron USA and the plaintiff that sued the company recently filed a joint motion for dismissal in an asbestos lawsuit brought in Jefferson County District Court.
Representing the estate of John Buller, Alice Buller filed the suit on Nov. 25, 2014, alleging the defendant acted with gross negligence.
According to the lawsuit, John was employed by Gulf Oil (now Chevron) and was exposed to toxic asbestos dust and fibers.
As a result, he developed mesothelioma, “from which he died a painful and terrible death on July 14, 2014,” the suit states.
The suit accuses the defendant knew for decades that asbestos products cause cancer but still allowed their employees to work around the products in the workplace.
The suit also says the defendant failed to warn of the dangers and provide training to prevent asbestos exposure.
Court records show that a joint motion for dismissal with prejudice was filed in the case on Oct. 9.
The plaintiffs are represented by Provost Umphrey attorney Keith Hyde.
Judge Kent Walston, 58th District Court, is assigned to the case.
