Woman alleges Toyota failed to manufacture crashworthy car

TEXARKANA – A Mount Pleasant woman has filed a suit against an auto manufacturer after her daughter sustained fatal injuries in a car crash.

Rosemary Iberra, individually and as representative of the estate of Jessica Morales Leija, and as next friend to C.S., E.S., L.S. and N.S., minor children filed a complaint on Oct. 25 in the Texarkana Division of the Eastern District of Texas against Toyota Motor Corp. alleging that the automobile manufacturer failed to manufacture crashworthy vehicles.

According to the complaint, the plaintiff alleges that on June 28, plaintiff's decedent and daughter Morales Leija was driving a 2006 Toyota Scion on the on ramp of Interstate 30 in Mount Pleasant when she experienced an accident. Despite being properly seated and properly wearing the three-point seat belt, the suit states she sustained fatal injuries when the vehicle failed to protect her. 

The plaintiff holds Toyota Motor Corp. responsible because the defendant allegedly failed to manufacture vehicles that can maintain survival space, can provide proper restraint, can prevent ejection and can prevent post-crash fires.

The plaintiff seeks actual damages, pre- and post-judgment interest, costs of court and such other general and special relief. She is represented by E. Todd Tracy, Stewart D. Matthews and Andrew G. Counts of The Tracy Firm in Dallas.
