HOUSTON – A Houston consumer alleges a debt collector has the wrong number.
Chris D. Davis filed a complaint on Oct. 30 in the Houston Division of the Southern District of Texas against Dynamic Recovery Solutions LLC alleging that the debt collector violated the Fair Debt Collection Practices Act and the Telephone Consumer Protection Act.
According to the complaint, the plaintiff alleges that beginning in fall 2016, he began receiving calls to his cellular phone from the defendant attempting to collect upon a debt owed by another unknown individual. As a result, he alleges he has been annoyed, harassed, oppressed and abused and has expended approximately $56 to maintain a phone application to quell defendant’s calls.
The plaintiff holds Dynamic Recovery Solutions LLC responsible because the defendant allegedly continued to call him even after being notified to stop and that it was contacting the wrong individual, made calls using an automatic telephone dialing system and without his prior express consent.
The plaintiff seeks actual and punitive damages, attorney fees, costs and any other relief as the court deems just and appropriate. He is represented by Nathan C. Volheim and Taxiarchis Hatzidimitriadis of Sulaiman Law Group LTD in Lombard, Illinois.
