HOUSTON – A shop worker alleges he was not paid the appropriate wage rate for overtime work.
Otis Vanardo, individually and on behalf of all others similarly situated, filed a complaint on Oct. 30 in the Houston Division of the Southern District of Texas against Taylor Smith Consulting LLC alleging that the former employer violated the Fair Labor Standards Act.
According to the complaint, the plaintiff worked for the defendant from May 1 to Sept. 6 as a shop worker. He alleges that during his tenure with defendant, he regularly worked in excess of 40 hours per workweek without receiving overtime premiums.
The plaintiff holds Taylor Smith Consulting LLC responsible because the defendant allegedly failed to pay a rate of time-and-one-half of his regular wage rate for overtime hours worked.
The plaintiff requests a trial by jury and seeks unpaid overtime wages, liquidated damages, attorney’s fees and any further relief as the court deems just and equitable. He is represented by Josef F. Buenker of The Buenker Law Firm in Houston.
