Brake Check service manager alleges he is owed unpaid wages

HOUSTON – A service manager for an automotive repair shop alleges he is not paid for all hours worked.

James Radford, individually and on behalf of all others similarly situated, filed a complaint on Nov. 6 in the Houston Division of the Southern District of Texas against Peveto Cos. LTD, doing business as Brake Check, alleging that the automotive repair shop violated the overtime provisions of the Fair Labor Standards Act.

According to the complaint, the plaintiff is a service manager for the defendant and began his employment in May 2016. He alleges he is wrongfully classified as exempt from overtime pay. 

The plaintiff holds Peveto Cos. LTD responsible because the defendant allegedly failed to pay him for all hours worked and did not pay overtime compensation.

The plaintiff requests a trial by jury and seeks unpaid wages, liquidated damages, costs, attorney's fees and such other relief as is proper and just. He is represented by Gregg M. Rosenberg and Tracey D. Lewis of Rosenberg & Sprovach in Houston.
