Two individuals allege DRR Construction has failed to complete house in timely manner

GALVESTON – A Galveston County contractor is alleged to have failed to complete the construction of a residence on time.

Blanca De La Garza and Daysi V. Pena filed a complaint on Nov. 6 in the Galveston County District Court against Alejandro Silva, doing business as DRR Construction, alleging breach of contract and unjust enrichment.

According to the complaint, the plaintiffs allege that on July 14, 2016, they contracted defendant for the construction of a new residence in Texas City for a total price of $300,000. They allege that they have paid 85 percent of the cost under the contract, but the home is only 33 percent complete as of Oct. 25.

The plaintiffs hold Silva responsible because the defendant also allegedly failed to maintain an account for the construction account in violation of the Texas Property Code.

The plaintiffs seek monetary relief of more than $200,000 but not more than $1 million and such other lawful and equitable relief. They are represented by Alberto E. Ruiz and Aaron Cowart of The Ruiz Law Firm PLLC in Pearland.
