GALVESTON — A couple is suing a Galveston hotel operator, alleging negligence in that insufficient measures were taken to prevent injuries.

Maria Ann Garcia-Stevenson and Kenneth Stevenson, individually and on behalf of their minor son Kierston Stevenson, filed a complaint Nov. 8 in Galveston County District Court against Moody Gardens Inc., alleging the hotel operator breached its duty to maintain the shower rooms in a reasonably safe condition.

According to the complaint, on July 19, 2016, the plaintiffs were staying in a room at the defendant's Moody Gardens Hotel on Hope Boulevard, Galveston. While Garcia-Stevenson was showering, the suit says, she gripped the support bar when, suddenly and without warning, the bar came out of the wall, causing her to fall and injured herself.

Garcia-Stevenson said she received injuries to her back, neck, disk, ligaments and other parts of her body. Plaintiffs Kenneth Stevenson and Kierston Stevenson say they suffered loss of consortium, service and the society of Garcia-Stevenson.

The plaintiffs allege Moody Gardens negligently allowed the support bar in the shower to be in a defective condition that posed an unreasonable risk of harm.

The plaintiffs seek trial by jury, actual damages, with interest, court costs and all other just relief. They are represented by attorney Lauren Brossette of Broussard & Hart LLC in Lake Charles, Louisiana.
