Consumer accuses telemarketers of invasion of privacy

SHERMAN — A Plano man is suing telemarketers, alleging misleading representations and violation of federal law.

Craig Cunningham filed a complaint Nov. 9 in Sherman Division of the Eastern District of Texas against CBC Conglomerate LLC, Bruce Phillip Hood, Carey Gorge Howe, et. al., alleging they violated the Telephone Consumer Protection Act and the Fair Debt Collection Practices Act.

According to the complaint, Cunningham has received multiple phone calls from the defendants offering unsolicited student loan consolidation services. As a result of the defendants' unlawful actions, the suit says, Cunningham has been harassed, annoyed and abused. 

The plaintiff alleges the defendants falsely claimed they are part of the U.S. federal government, and made calls using an automated telephone dialing system and pre-recorded voice messages.

Cunningham seeks trial by jury, statutory damages of $3,000 for each phone call and $1,000 for each FDCPA violation, with interest and all other just and proper relief. The plaintiff is representing himself.
