HOUSTON – A Houston man has filed suit against a two medical supply companies over allegations a bed he was provided caused him to develop a pressure sore.
Jeffrey Page Winters filed a complaint on Nov. 9 in the Harris County District Court against MP Healthcare Medical Supply LLC and Medical Depot Inc., doing business as Drive DeVilbiss Healthcare, alleging negligence, breach of warranty and other counts.
According to the complaint, the plaintiff has been a paraplegic since birth. The suit states he needs a Hoyer lift and specialty bed to enable him to get from his wheelchair to his bed, and he ordered a specialty bed and mattress through MP Medical. The suit states a mattress was delivered with its required air pump on Nov. 10, 2016, and because the mattress did not provide proper support, the plaintiff developed a deep tissue bruise. The plaintiff alleges this bruise developed into a stage four pressure sore and developed sepsis.
The plaintiff holds M.P. Healthcare Medical Supply LLC and Medical Depot Inc. responsible because the defendants allegedly failed to properly install the mattress.
The plaintiff requests a trial by jury and seeks damages of more than $100,000, plus interest, and such other lawful and equitable relief. He is represented by George E. Cire Jr. of Cire Law Firm in Houston.
