Motorist seeks damages from Elite Service Recovery & Towing after load struck vehicle

TYLER – A motorist is seeking damages from a trucking company and its driver after a collision in Anderson County.

Abraham Leon Goldfarb filed a complaint on Nov. 10 in the Tyler Division of the Eastern District of Texas against Elite Service Recovery & Towing LLC and Dennis Wayne Baggett alleging negligence and other counts.

According to the complaint, the plaintiff alleges that on June 19, he was seriously injured when the 12-foot wide portable building on defendants' tractor and flat-bed trailer rig hung over into his lane of travel and struck his vehicle. The suit states the collision occurred on U.S. Highway 175 in Anderson County in a construction zone.

The plaintiff holds Elite Service Recovery & Towing LLC and Baggett responsible because defendant Elite allegedly failed to secure a valid permit for transporting portable buildings, did not use an escort flag vehicle in transporting the same and defendant Baggett allegedly failed to keep the vehicle and/or its cargo within his lane of travel.

The plaintiff seeks compensation in excess of the court’s minimum jurisdictional limits, punitive damages, pre- and post-judgment interest and all other relief that are appropriate. He is represented by Karen R. Roberts and Bruce Roberts of Roberts & Roberts in Tyler.
