DALLAS – Two Dallas County consumers allege two debt collectors used false and deceptive representations to collect an alleged debt.
Jaime and Dustin Hardy, individually and on behalf of all others similarly situated, filed a complaint on Nov. 10 in the Dallas Division of the Northern District of Texas against Bowen and Associates Inc. and Bowen and Associates Recovery Inc. alleging that they violated the Fair Debt Collection Practices Act and the Texas Debt Collection Practices Act.
According to the complaint, the plaintiffs allege that in November 2016, they began receiving calls from defendants attempting to collect an alleged debt. As a result of defendant's unlawful conduct, they allege they were oppressed, annoyed, abused and harassed.
The plaintiffs holds Bowen and Associates Inc. and Bowen and Associates Recovery Inc. responsible because the defendants allegedly failed to identify themselves as debt collectors and made the plaintiffs believe that defendants were a law firm that was calling.
The plaintiffs request a trial by jury and seek an order certifying this action as a class action, award for actual, punitive and statutory damages, penalties, attorneys’ fees, expenses and costs and such other relief that are appropriate.
