Tomball ISD alleged to have failed to pay contractor in full for construction of school

HOUSTON – A Houston contractor alleges that it was not paid in full for the construction of a junior high school.

Webber Commercial Construction LLC, formerly known as Pepper Lawson Construction LP, filed a complaint on Nov. 16 in the Harris County District Court against Tomball Independent School District alleging breach of contract.

According to the complaint, the plaintiff alleges that, in Dec. 9, 2013, the parties entered into a written contract whereby plaintiff would provide labor and materials to construct the Creekside Park Junior High School for a guaranteed maximum price of $38,790,526. The contract balance of allegedly $844,733 remains due and owing. 

The plaintiff holds Tomball Independent School District responsible because despite repeated demands, the defendant allegedly failed and refused to pay the amounts owed to plaintiff.

The plaintiff requests a trial by jury and seeks monetary relief of more than $200,000 but not more than $1 million and such other relief to which it may show itself justly entitled. It is represented by Timothy C. Ross and Lauren Scroggs of Andrews Myers PC in Houston.
