Adams, London & Weiss alleges debt collection contract was breached

HOUSTON – A Houston debt collector alleges that a medical facility breached a contract.

Adams, London & Weiss LLC filed a complaint on Nov. 21 in the Harris County District Court against Memorial Spring Branch Neonatology Consultants PA, Exact Billing Corp. and Sandra Elshere alleging breach of contract.

According to the complaint, Memorial Spring Branch Neonatology Consultants PA contracted the plaintiff to collect unpaid patient accounts in July 2017. The suit states Exact provides accounting and billing services to Neonatology.

The plaintiff alleges that it expended substantial time and effort in sending out approximately 2,416 collection letters as instructed by defendant Neonatology. It alleges that once payments began, Exact and Elshere "engaged in a conscious course of conduct to interfere with the contract between Neonatology and Adams to divert the collection of fees."

The suit states Neonatology sent the plaintiff a cease and desist letter in September and has failed to pay the cancellation charge.

The plaintiff seeks monetary relief of more than $200,000 but not more than $1 million and all other general and special relief to which it may be entitled. It is represented by Ron S. Rainey and L. James Krell of Tritico Rainey PLLC in Houston.
