Man sues nonprofit for investigating property without warrant

HOUSTON – A Harris County resident accuses a nonprofit agency of entering his property without his permission.

Earl Wayne Duncan, Jr. filed a lawsuit against the Houston Society for the Prevention of Cruelty to Animals in the Harris County 80th District Court on Nov. 21.

At issue of the complaint is a HSPCA investigator approaching a kernel belonging to Duncan and proceeding to photograph the aforementioned property.

Court documents claim the investigator did not possess a warrant or a court order nor was accompanied by any person who had an actual statutory duty to perform investigations related to civil or criminal codes for the state.

Per Duncan, he attempted to retrieve the HSPCA’s images to no avail.

Consequently, the complainant seeks approximately $50,000 in damages in addition to a jury trial.

He is representing himself.
