Keane Frac sand hauler alleges he is owed unpaid overtime wages

HOUSTON – A Dallas County man employed as a sand hauler alleges he was paid straight time for overtime work.

Vu Tran, individually and on behalf of all others similarly situated, filed a complaint on Nov. 22 in the Houston Division of the Southern District of Texas against Keane Frac TX LLC, Keane Frac ND LLC, Keane Frac GP LLC, et al. alleging violation of the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that he was damaged for not receiving proper overtime compensation at a rate of time-and-one-half for hours worked over 40 in a workweek.

The plaintiff holds Keane Frac TX, LLC, Keane Frac ND LLC, Keane Frac GP LLC, et al. responsible because the defendants allegedly paid him at his straight time rate for all hours worked over 40 hours in a workweek and failed to maintain accurate time and pay records.

The plaintiff requests a trial by jury and seeks an order allowing this action to proceed as a collective action, award for all unpaid overtime wages, liquidated damages, attorneys’ fees and costs and such other and further relief. He is represented by Melissa Moore, Curt Hesse and Bridget Davidson of Moore & Associates in Houston.
